Purpose

Section 105(1) of the Land Transport Management Act 2003 requires every regional council to establish a Regional Transport Committee for its region.

Role

·                Prepare a regional land transport plan, or any significant variation to the plan, for the approval of the Regional Council.

·                Approve any non-significant variation to the regional land transport plan.

·                Adopt a policy that determines significance in respect of:

§  variations made to regional land transport plans under section 18D of the Land Transport Management Act 2003; and       

§  the activities that are included in the regional land transport plan under section 16 of the Land Transport Management Act 2003.

·                Monitor implementation of the regional land transport plan.

·                Make recommendations in support of land transport activities that are eligible for national funding and align with the regional land transport plan.

·                Consolidate individual road controlling, authority (RCA) speed management plans and prepare the regional speed management plan in accordance with the Land Transport Rule: Setting of Speed Limits 2022.

·                Co-ordinate, integrate and adopt regional transport and land-use strategies and plans.

·                Provide advocacy on strategic regional and inter-regional transport matters to Central Government and other key stakeholders as appropriate.

·                Provide the Regional Council with any advice and assistance the Regional Council may request in relation to its transport responsibilities.

·                Approve submissions to Central Government, local authorities and other agencies on Regional Transport Committee matters.

·                Monitor and provide advocacy on regional road safety matters.

Committee Procedures

·                Membership consists of two representatives of the Bay of Plenty Regional Council, the Mayor of each territorial authority in the region and a representative of the New Zealand Transport Agency.

·                In the case of an equality of votes, the chair, or any other person presiding the meeting does not have a casting vote (and therefore the act or question is defeated and the status quo is preserved).

·                The Regional Transport Committee may appoint external advisors to assist it in the exercise of its specific responsibilities and delegated authority. For the purposes of clarity, external advisors may be given full speaking rights at the discretion of the committee, but are not entitled to vote on committee matters.

·                Under the Local Government Act 2002, the Regional Transport Committee is not defined as a joint committee however, the provisions of the Local Government Act 2002 and the Local Government Official Information and Meetings Act 1987 concerning the meetings of committees of regional councils, so far as they are applicable and with the necessary modifications, apply in respect of meetings of the Regional Transport Committee.

Mike Williams – State Highway 2 Western Bay of Plenty Safety

Tabled Document 1 - Traffic volumes coming out of side roads between Katikati and Ōmōkoroa which do not have roundabouts (or proposed roundabouts): Objective ID A4600720

Key Points:

·      Highlighted potential effects to residents of the wire rope safety barriers proposed by Waka Kotahi to be installed on State Highway 2 between Katikati and Ōmōkoroa, particularly intersections where no roundabouts would be present:

o   Residents unable to cross these intersections would have increased travel time to commute or visit neighbouring towns e.g. Katikati which could impact upon local businesses with people being forced to travel in a different direction to shop etc.

o   Further considerations to be made were impacts to public transport and the additional response time for emergency services to attend a serious event

o   Acknowledged the open days Waka Kotahi held during community consultation but noted that most of the submissions received were against the wire safety barriers being installed, particularly across intersections

·        Suggested alternative options e.g. seagull intersections

·        Considered that wire rope barriers did not enhance safety at intersections, and could create additional danger by causing road users to perform U-turns to travel in their desired direction.

Key Points - Members:

·       Shared concern over wire rope barriers being carried through intersections, and the implications arising from this.

In Response to Questions – Waka Kotahi:

·        One of the primary functions of wire rope barriers was to prevent right turns out of an intersection, along with preventing head on collisions

·        Many alternatives had been investigated by road engineers before wire rope safety barriers were chosen as the safest option - there were trade-offs between the cost of death and serious injury and additional travel time for residents

·        The Bay of Plenty region had four of the ten most dangerous state highways in the country 

·        Would pass comments made onto to the safety team for response (Committee Advisor to provide contact details).

NZ Transport Agency Waka Kotahi Update

Presentation: NZ Transport Agency Waka Kotahi Quarterly Update: Objective ID A4600823   

Presented by: David Speirs - Director, Regional Relationships

 

Key Points:

·      The Ministry of Transport (MoT) reviewed the Government Policy Statement on land transport (GPS) and the next draft was anticipated to be released late February/early March 2024.  This would determine the funding categories available, and the priority that each of those would receive

·      Electric Vehicles would now be subject to Road User Charges (RUC) from 1 April 2024, including plug-in hybrid vehicles (PHEV)

·      The Setting of Speed Limits Rule was to be revoked and a new rule was being developed.  A key change from this was that the requirement to develop a Speed Management Plan was now discretionary, rather than mandatory

·      Outlined the maintenance and operations programme for the 2023/24 season and the revised targets, including initial dates for night time closures to State Highway 29 (February to July 2024)

·      State Highway 2 Baypark to Bayfair link – all major infrastructure components were now completed

·      State Highway 29 Tauriko enabling works – the construction phase was expected to commence in March 2024, beginning with Cambridge Road

·      Takitimu North Link - Cambridge Road Overbridge flyover required a three month road closure and diversion

·      The remaining two sections of safety improvements on State Highway 2 Wainui Road to Ōpōtiki were awaiting funding

·      Completion of Phase One of State Highway 30 Eastern Corridor Improvements at Rotorua were expected to be completed mid-2024.

Key Points - Members:

·      There had been a lack of public consultation for introduction of the electric vehicle RUC, particularly PHEVs and agreed that further consideration needed to be given over how they could be charged in the future e.g. dynamic road pricing

·       Resealing operations on State Highway 2 coincided with the end of the school holidays, creating a significant travel delay (up to two hours Katikati to Tauranga)

·       Expressed concern that the removal of passing lanes on State Highway 2 had not been sufficiently communicated to the public.

In Response to Questions:

·        The intention had been to introduce RUC on electric vehicles once they reached two percent of New Zealand’s light vehicle fleet, which had now been exceeded

·        Existing Speed Management Plans that had already been certified would remain in place

·        Impacts had been observed due to the price and supply challenges of bitumen

·        There were significant efficiency and safety benefits to temporarily closing a portion of a road for maintenance and operations, noting that one of the biggest challenges was identifying safe and appropriate detours

·        Modelling for State Highway 20 enabling works would be available once the contract was processed

·        Hewletts Road sub-area upgrade was progressing and was in the consultation phase with a preliminary design.

Key Points:

·        The draft 2024-2034 Regional Land Transport Plan (RLTP) document was almost complete with feedback from members incorporated and graphics input underway

·        Acknowledged that the current programme required the draft RLTP to go out for consultation in approximately two weeks’ time to meet statutory obligations.

Key Points - Members:

·        The sense of urgency within the Executive Summary and the Statement of Proposal regarding the significance of the issues from an economic and affordability perspective should be enhanced.  The size and significance of the funding issues should be addressed and made clearer, and the urgent need for alternative funding methods to bridge the gap should be added.  Suggested the wording from Page 21 of the draft RLTP which showed the significance of these issues, be up front in the Executive Summary

·        Questioned where the wording on Page 48 of the draft RLTP under inclusive access came from: ‘opportunities to allocate national land transport funding to Māori roadways’

·        Noted the incongruity between the Headline Target and sub-target for mode shift.  The Headline Target was 20% for Public Transport (PT) and Active Modes, whereas the sub-target for PT was 10% - the percentage between the sub-target and the target had to be kept consistent.  Otherwise, there would be a need to achieve a 27% increase per annum for PT to achieve the 20% target by 2032, which the Environmental Sustainability Advisor considered was unlikely

·        Ensure that the regionwide map was updated to include the prioritisation revisions made in the workshop held directly prior to the meeting, and reflected representation across the entire region

·        Thanked staff and members of the Regional Advisory Group for the work undertaken in developing the RLTP.

In Response to Questions:

·        Mode shift would be correlated to the level of investment and the speed of which projects were delivered to support people travelling using alternative modes.

That the Regional Transport Committee:

1        Receives the report - Approval of the draft statement of proposal for the draft Regional Land Transport Plan 2024 – 2034 (draft RLTP 2024) and the proposed consultation approach;

2        Approves the draft Regional Land Transport Plan 2024-2034 document for public consultation in accordance with the requirements of the Land Transport Management Act 2003;

3         Authorises the Manager, Transport Planning, in consultation with the Chair of the RTC, to include additional text describing the regional benefits associated with top priority projects added at the workshop held immediately prior to this meeting; 

4        Authorises the undertaking of a special consultative procedure, as provided for by the Local Government Act 2002, to consult on the draft Regional Land Transport Plan;

5        Approves the statement of proposal, including the consultation questions;

6        Authorises the Manager, Transport Planning, in consultation with the Chair of the RTC, to include the activity prioritisation list (as per guidance provided at the workshop held immediately prior to this meeting) and to make any necessary formatting and minor grammatical changes to the draft Regional Land Transport Plan and Statement of Proposal prior to its release to the public; and

7           Notes that Hearings and Deliberations on the draft 2024-2034 Regional Land Transport Plan will be undertaken by the full Committee.

7.     Verbal Update Opportunities from Committee Members and Advisors

Greg Pert – Freight Advisor

·        Highlighted a recent media release regarding the use of heavier and longer trucks now being required to move the same volume of freight in order to reduce emissions and congestion, as well as reduce the safety risk for other road users. 

Stacey Spall – NZ Automobile Association  (AA) Advisor

·        Outlined work underway with the AA Research Foundation producing road safety focused research for New Zealand, which was expected to be completed by June 2024 and focused on low cost safety treatments for rural intersections.

 

Dan Kneebone – Port of Tauranga Advisor

·        The Port remained committed to delivering resilient infrastructure to New Zealand and advised that an interim decision had been received on 13 December 2023 for Stage One of the Port berth extension at Sulphur Point, subject to a number of court directions.  The focus over the next six months would be on compliance with these. 

 

 

Inspector Logan Marsh – NZ Police Road Safety Advisor

Presentation: New Zealand Police Bay of Plenty Road Safety Update: Objective ID A4605415   

 

Key Points:

·        Provided an update over the past 12 months in the Bay of Plenty region:

o Road deaths – There had already been five fatalities on the road this year

o Total traffic notices by subregion had increased significantly in 2023 – over 70,000 in the past year, with notable increases in the Eastern Bay of Plenty, Taupō and Rotorua

o Over 287,000 alcohol tests had been carried out in the region.  High results were still being recorded for evidential breath tests

·        Outlined NZ Police priorities and focus for 2024 including rural/state highway locations, driver impairment and distraction/inattention, adherence to speed limits

·        Education – Beginning implementation of The Right Track Programme: working proactively with a focus on young people in the education space.

Key Points - Members:

·        Raised that the most substantial issues for the Eastern Bay of Plenty were not wearing seatbelts and operating vehicles with excess breath alcohol.

Regional Land Transport Plan 2024-2034 Hearings

 

Executive Summary

The purpose of this report and accompanying documentation, is to provide a copy of submissions received to the Draft Regional Land Transport Plan 2024-34 consultation. This is to support the Hearings process, occurring on 10 to 12 April 2024.

To-date 133 submissions have been received, including nine late submissions which were received after the close of the consultation period on 24 March 2024.  A total of 29 submitters have indicated that they wish to be heard.

 

Recommendations

1.  That the Regional Transport Committee:

1        Receives the report, Regional Land Transport Plan 2024-2034 Hearings;

2        Receives and, if requested, agrees to hear late submissions to the draft Regional Land Transport Plan 2024-2034 received after the closing date for submissions;

3        Receives tabled documents from submitters during the Hearings.

4        Confirms the public be excluded on the grounds set out in the Local Government Official Information and Meetings Act 1987 from consideration of the following report attachment:

(a)  All Submissions to the Draft 2024-2034 Regional Land Transport Plan (UNREDACTED) under Section 48(1)(a)(i) Section 7 (2)(a) as withholding the information is necessary to protect the privacy of natural persons, including that of deceased natural persons and that this attachment remain in Public Excluded.

 

1.       Background

The Land Transport Management Act 2003 requires Regional Councils to ensure that the relevant regional transport committee prepares, on the regional council’s behalf, a regional land transport plan every 6 financial years.

The Regional Transport Committee (RTC) has undertaken a thorough process to develop a draft Regional Land Transport Plan 2024-34 (draft RLTP). The draft RLTP, supporting Statement of Proposal document and Communications and Engagement Plan were adopted for consultation by the RTC on 09 February 2024.

A special consultative procedure was carried out between 23 February 2024 and 24 March 2024.

2.       Submissions

2.1      Consultation

A total of 133 submissions were received, with 29 respondents indicating that they wished to be heard at the Hearings. 

Initial analysis of submissions showed the following:

Demographics

·      50% of the submissions were from respondents located in the Western Bay of Plenty sub-region, with most of these being from community members and organisations located within Tauranga.

·      30% of submitters did not wish to record their address or location.

·      74% of submitters were individuals.

Response to consultation questions

The consultation asked three agree/disagree questions, followed by an open question for comments/feedback.

1.   How much do you agree that these are the transport challenges the region is facing?

82% of the respondents either strongly agreed or agreed with the transport challenges identified for the region, with 8% of respondents either strongly disagreeing or disagreeing.

2.   How much do you agree with the transport objectives?

 

72% of the respondents either strongly agreed or agreed with the transport objectives identified for the region, with 14% of respondents either strongly disagreeing or disagreeing.

3.   How much do you agree with the proposed list of priority projects?

56% of the respondents either strongly agreed or agreed with transport priorities for the region, with 23% of respondents either strongly disagreeing or disagreeing.

Summary

Across the agree/disagree questions, the majority of respondents either strongly agreed or agreed with the challenges, objectives and priority projects in the RLTP.

The highest level of disagreement was for Regional Priorities. Where reasons were given, these included a dissatisfaction with the geographic spread of projects as well as concerns pertaining to specific activities included in the prioritised list, an example being construction related disruption associated with major corridor upgrades.

Initial analysis of the submissions shows the following themes:

o   Agree or disagree answers show general support for the direction of the RLTP.

o   Agreement with the objectives, but some concern over the achievability of KPIs.

o   Some submitters mentioned unsustainable growth is causing congestion and the need to focus on improved spatial/urban planning to support sustainable communities.

o   Some submitters viewed the alignment with the draft Government Policy Statement for Land Transport (GPS) as insufficient.

 

Climate change and Emissions Reduction

o   Support for environmental sustainability as an objective, reducing emissions and protecting the environment.

o   Feedback regarding climate change and emission reduction was generally positive.

 

Regional Focus

o   Some submissions highlighted the perception of a strong Tauranga focus for the prioritised projects, and not enough representation of the wider region.

o   Support for the inclusive access objective, noting rural community reliance on private cars and lack of accessibility for rural areas.

 

Active modes

o   Both positive and negative feedback on cycleway improvements, with the general balance in support.

o   Support for improving road safety and highlighting safety concerns for those using active modes.

 

Public transport

o   Request to increase public transport frequency, increased PT hubs and an overall increase in PT investment.

o   Some support for park and ride sites in Pāpāmoa and Tauriko.

o   Some support for ferry service between Ōmokoroa and Tauranga.

 

Rail

o   Some support for progressing a passenger rail business case.

o   Some support for passenger rail, to promote behaviour change to support less congestion, particularly in Tauranga.

o   Some support for inter-regional passenger rail to between Tauranga, Hamilton, and Auckland.

o   Support for increased freight movement by rail.

More detailed analysis will be undertaken for the Deliberations report.

Three submitters requested an extension to the due date, and staff have received nine late submissions. Inclusion of these late submissions is subject to the discretion of the RTC (Recommendation 2). Staff support the inclusion of the late submissions, as it has been possible to process these in time for the scheduled Hearings.

2.2      Hearings

The Hearing of submissions are scheduled to take place on:

·      10 April 2024: Regional House Chambers. Elizabeth St, Tauranga - 9.30 am to 5 pm.

·      11 April 2021: Waiariki Room BOPRC. Fenton St, Rotorua - 9.30 am to 12 pm.

·      12 April 2021: Mātaatua Room BOPRC. Quay St, Whakatāne - 9.30 am to 12 pm.

2.3      Submissions Pack

This submissions pack contains submitter and submission information to support the Committee with the Hearings process, and includes the following:

·      A draft Hearings schedule, setting out the timing of the Hearings sessions.  Please note this is a draft schedule and may be subject to change.  A final schedule will be provided at the start of each Hearing session, and a live updated version is available on the website from 5th April 2024, which can be accessed via the following link: https://www.boprc.govt.nz/your-council/plans-and-policies/plans/regional-plans/regional-land-transport-plan/

·      All submissions received.

It should be noted that any identifying, private submitter information will be redacted from public-facing documents to fulfil the requirements of the Privacy Act 2020 and the Local Official Information and Meetings Act 1987.

3.       Considerations

3.1      Risks and Mitigations

Development of the RLTP is at a critical stage. Since the draft RLTP was endorsed by the RTC for public consultation, the Government has released the draft GPS 2024. It is the view of Staff that the draft RLTP generally aligns with the direction of the new GPS, and further alignment can be achieved through relatively minor adjustments to drafting and lexicon.

Furthermore, the progression of Territorial Local Authority and the Regional Council LTPs, as well as the release of NZTA Waka Kotahi’s updated State Highway Investment Proposal (SHIP) may require changes to the RLTP, especially to the financial sections of the document.

All suggested adjustments made to the document either by Staff, or because of submissions, will be discussed during Deliberations in May 2024.

The RLTP provides opportunities for both mitigation of the effects of climate change, through greenhouse gas reduction and adaptation of the transport system to the ongoing effects of climate change.

Objective 2 of the Draft RLTP focusses on climate change mitigation, while Objective 5 focuses on climate change adaptation.

3.3      Implications for Māori

The draft RLTP 2024 sets out the region’s proposed land transport programme and seeks funding for activities included.  Therefore, it has a range of potential impacts on Māori and Council partnerships with Māori. Some specific activities proposed in the RLTP, have the potential to impact Māori Land and their development aspirations.

The RTC is well placed to receive submissions from Māori. Specific engagement has included use of the Komiti Māori e-panui. Submissions from Māori land trusts and organisations throughout the rohē have been received.

Consultation was carried out under s82 of the Local Government Act 2002 (Special Consultative Procedure).

Specific communication and engagement activities included:

·       Community engagement events at Ōpōtiki Library, Ōmokoroa Night Market, Rotorua Night Market, Bayfair Shopping Centre and Rangitāiki River Festival (Thornton Beach).

·       Promotion through partner Territorial Authorities (TA’s).

·       Promotion through Regional Council Long Term Plan events during the concurrent LTP consultation.

Digital engagement:

·       Promotion via BOPRC Website and social media, directing the community to BOPRC’s online engagement platform “Participate”

·       Traffic to the Participate page arrived from the following locations:

o   58% from email campaigns and digital newsletters.

o   23% arrived directly.

o   10% from social media links/adverts.

o   9% from other sources, such as search engines.

3.5      Alignment with Strategic Framework

The development of the draft RLTP 2024 directly contributes to “Connect Communities” Community Outcome in the Council’s draft Long-Term Plan 2024-2034.

The LTMA requires every regional council to establish an RTC; and sets the functions of the RTC and a mandate for preparing the RLTP. The RLTP supports regional collaboration on transport issues and the provision of a more effective and efficient transport network. This ultimately supports the Regional Council’s strategic framework and specifically the Vibrant Region outcome within the Long-Term Plan 2021-2031.

3.6      Financial Implications

The development of the RLTP is being undertaken within the current budget for the Transport Planning Activity in the Regional Council’s Long-Term Plan 2021-2031.

4.       Next Steps

4.1      Deliberations

A Hearings Recommendations Paper and an Officers Submissions Report will be provided to the RTC for the public excluded Deliberations meeting on 7 May 2024.  Staff will also be developing position papers on any key issues following the Hearings if needed.  The Deliberations pack will be sent to the RTC with an agenda.

4.2      Adoption

Adoption under the Land Transport Management Act 2003 is a two-step process.  The Regional Transport Committee will meet to adopt/endorse the Regional Land Transport Plan 2024-2034 on 22 May 2024.

The Regional Council will meet to adopt the Regional Land Transport Plan 2024-2034 on 22 May 2024.

A finalised, adopted RLTP 2024-2034 will be sent to NZTA by the 1 August 2024 for its consideration for funding and inclusion in the National Land Transport Programme (NLTP).
