Purpose and Role
The Bay of Plenty Civil Defence Emergency Management Group Hearings Panel was appointed by the Bay of Plenty Civil Defence Emergency Management Group to hear submissions from the public on the draft Bay of Plenty CDEM Group Plan 2023-28 on behalf of the Bay of Plenty CDEM Group.

Draft Bay of Plenty Civil Defence Emergency Management Group Plan 2023-28 - Hearings Report
Executive Summary The draft Bay of Plenty Civil Defence Emergency Management Group Plan 2023-2028 was approved by the Bay of Plenty Civil Defence Emergency Management Group Joint Committee for public consultation on 30 June 2023. The Bay of Plenty Civil Defence Emergency Management Group has received eight submissions on the draft Bay of Plenty Civil Defence Emergency Management Group Plan, two of the submissions will be heard at the Hearings. |
That the Bay of Plenty Civil Defence Emergency Management Hearings Panel:
1 Receives the report, Draft Bay of Plenty Civil Defence Emergency Management Group Plan 2023-28 - Hearings Report;
2 Appoints _______________ as Chairperson of the Bay of Plenty Civil Defence Emergency Management Group Hearings Panel.
Section 52 of the Civil Defence Emergency Management Act 2002 requires the Bay of Plenty Civil Defence Emergency Management Group to give interested parties the opportunity to make submissions on the draft Bay of Plenty Civil Defence Emergency Management Group Plan 2023-2028. Submissions on the draft Bay of Plenty Civil Defence Emergency Management Group Plan 2023-2028 were open from 8 July 2023 through to 13 August 2023.
Those who wished to speak to submissions were provided with the opportunity to be heard at the hearings, scheduled for 4- 6 September 2023.
The Civil Defence Emergency Management Group Joint Committee appointed Mayors Faylene Tunui, James Denyer and Deputy Mayor Sandra Kai Fong as members of the Joint Committee to sit on the hearing panel at the CDEM Joint Committee meeting held on 4 September 2023. Panel members are to nominate, agree and appoint a Hearings Panel Chairperson.
Due to the unavailability of Deputy Mayor Sandra Kai Fong to attend the hearings, Mayor Tania Tapsell was subsequently appointed to the hearings panel at an Extraordinary Bay of Plenty Civil Defence Emergency Management Group Joint Committee meeting on 22 August 2023.
The Group has received eight submissions on the draft Bay of Plenty Civil Defence Emergency Management Group Plan 2023-2028. Two of the submissions will be heard at the Hearing on 4 September 2023.
A summary of the point and the decision being sought from the Bay of Plenty Civil Defence Emergency Management Group has been provided for each submission point. Copies of the two submissions are also enclosed for reference.
Submitters have been given 15 minutes to speak including questions from the panel. The first submitter is scheduled to be heard at 10:45am. After the two submitters have been heard the Hearing Panel will break at approximately 11.30am.
In support of the hearings process, hearings procedure documents are enclosed for reference.
4. Considerations
4.1 Risks and Mitigations
A risk register is being maintained as part of the project which will be monitored and managed through the Project Team. Risks will be reported on as required.
4.2 Climate Change
The matters addressed in this report are of a procedural nature and there is no need to consider climate change impacts in this paper. The impacts of Climate Change will be addressed in the CDEM Group Plan work programme and the Group Plan itself.

There are no material unbudgeted financial implications and this fits within the allocated budget.
5. Next Steps
Following hearings, a closed deliberation session will be held. At the opening of deliberations, staff will provide the hearings panel with the specific submission points and associated staff recommendations.
As part of the deliberations staff will work with the hearings panel to compile
a recommendations report. The Hearing Panel’s Recommendations
Report will be presented to the Bay of Plenty Civil Defence Emergency
Management Joint Committee on 29 September 2023 for approval.
